Privacy Policy

This English translation is provided for convenience. In the event of any discrepancy, the Russian version of this Policy prevails.

1. General provisions

This Privacy Policy (the “Policy”) has been prepared in accordance with Federal Law No. 152-FZ of July 27, 2006 “On Personal Data” (the “Law”). It sets out how personal data is processed and protected by Individual Entrepreneur, Head of Peasant (Farm) Enterprise Aleksandr Andreevich Mankeev (the “Operator”).

The Policy is a public document and is kept permanently available on дыханиеповолжья.рф (the “Website”) as required by part 2 of Article 18.1 of the Law.

The Operator’s top priority when processing personal data is to respect the rights and freedoms of individuals, including the right to privacy and to personal and family confidentiality.

The Policy applies to all information the Operator may obtain about visitors to the Website and about people who contact the Operator. By using the Website you accept this Policy and the terms of processing set out in it.

2. Definitions

  • Personal data – any information relating directly or indirectly to an identified or identifiable individual (the data subject).
  • Operator – the party that organizes and carries out the processing of personal data and determines its purposes, the scope of the data and the operations performed on it.
  • Processing – any operation or set of operations performed on personal data, with or without automated means.
  • Anonymization – operations after which it is impossible, without additional information, to attribute personal data to a specific data subject.
  • Blocking – the temporary suspension of processing, except where processing is needed to correct the data.
  • Destruction – operations after which the content of personal data cannot be restored, or which destroy the physical media holding it.
  • Disclosure – operations aimed at revealing personal data to a specific person or a defined group of people.
  • Dissemination – operations aimed at revealing personal data to an indefinite group of people.
  • Cross-border transfer – the transfer of personal data to the territory of a foreign state, or to a foreign authority, individual or legal entity.
  • Cookies – small pieces of data that the Website or third-party services store in a visitor’s browser and read back on later visits.

4. The Operator’s rights and obligations

The Operator has the right to:

  • receive accurate information and documents containing personal data from the data subject;
  • determine the scope of the measures needed to meet the obligations set out in the Law;
  • continue processing without the data subject’s consent in the cases expressly allowed by part 2 of Article 9 and part 1 of Article 6 of the Law.

The Operator is obliged to:

  • provide the data subject, on request, with information about the processing of their personal data;
  • organize processing in the manner required by Russian law;
  • respond to requests from data subjects and their representatives as required by the Law;
  • provide Roskomnadzor with the information it requests within the statutory deadline;
  • publish this Policy or otherwise keep it openly available;
  • take the legal, organizational and technical protection measures required by Articles 18.1 and 19 of the Law;
  • stop processing and destroy personal data in the cases set out in the Law;
  • notify Roskomnadzor of any unlawful or accidental transfer of personal data within the deadlines set by part 3.1 of Article 21 of the Law.

5. Your rights as a data subject

  • to obtain information about the processing of your personal data, to the extent set out in part 7 of Article 14 of the Law;
  • to request that your data be corrected, blocked or destroyed if it is incomplete, outdated, inaccurate, unlawfully obtained or no longer needed for the stated purpose;
  • to withdraw your consent to processing;
  • to object to the processing of your data for the promotion of goods and services;
  • to appeal the Operator’s actions or inaction to Roskomnadzor or in court;
  • to protect your rights and lawful interests, including compensation for losses and for moral harm.

6. Processing principles

Personal data is processed lawfully and fairly. The Operator does not process data for purposes incompatible with those for which it was collected, does not merge databases whose processing purposes are incompatible, and processes only data that matches the stated purposes. The scope of the data is proportionate to those purposes and is not excessive. The Operator keeps data accurate and up to date, and destroys or anonymizes it once the purposes have been achieved.

7. Categories of data subjects and the data processed

The Website has no registration forms, no user accounts, no checkout forms and no newsletter sign-up. Orders are placed through the Operator’s VK community, by phone or by email.

7.1. Website visitors

When you visit the Website, the following data is processed automatically:

  • your IP address;
  • your browser, operating system, device type and screen resolution;
  • your browser language and regional settings;
  • the date and time of your visit, the pages you viewed and where you came from;
  • your actions on the page: navigation, clicks, scrolling and time spent;
  • visitor identifiers assigned by web analytics services, and cookies.

This data is processed in anonymized form and does not by itself allow the Operator to identify you.

7.2. People who contact the Operator

If you contact the Operator by phone, by email or through the VK community, we process only the details you choose to share:

  • your name or full name;
  • your phone number;
  • your email address;
  • your delivery address and the details needed to hand the parcel over to a courier service, if you place an order for delivery;
  • the content of your message and of your correspondence with the Operator.

The Operator does not process special categories of personal data (racial or ethnic origin, political opinions, religious or philosophical beliefs, health, sex life) or biometric data. The Operator does not process the data of minors; the Website is not intended for anyone under 18.

Data you share directly in the VK community is also processed by the social network under its own privacy policy.

8. Purposes of processing

  • keeping the Website running and secure, and detecting technical faults;
  • analyzing traffic, measuring advertising performance and improving the Website’s content;
  • handling enquiries and replying to the people who send them;
  • entering into and performing a sales contract, including handing the parcel over to a courier service;
  • meeting the Operator’s obligations under Russian law, including tax law;
  • sending information about products, offers and news – only with your separate consent, which you may withdraw at any time.

9. Legal grounds

  • the data subject’s consent (clause 1, part 1, Article 6 of the Law), including consent to analytics cookies given in the notice on the Website;
  • the performance of a contract to which the data subject is a party, or of a contract entered into at their initiative (clause 5, part 1, Article 6 of the Law);
  • the performance of obligations imposed on the Operator by Russian law (clause 2, part 1, Article 6 of the Law);
  • the pursuit of the Operator’s legitimate interests, provided the rights and freedoms of the data subject are not infringed (clause 7, part 1, Article 6 of the Law);
  • Law of the Russian Federation No. 2300-1 of February 7, 1992 “On Consumer Rights Protection” and the Rules for the retail sale of goods.

10. How data is processed

Personal data is processed both with and without automated means. The following operations are performed: collection, recording, systematization, accumulation, storage, updating, retrieval, use, transfer (disclosure and access), anonymization, blocking, deletion and destruction.

The Operator does not make decisions producing legal effects for a data subject solely on the basis of automated processing. The Operator does not disseminate personal data to an indefinite group of people.

11. Cookies and web analytics

The Website uses cookies and browser local storage. Strictly necessary items keep the Website working: they remember your interface language, your light or dark theme, the contents of your cart and the choice you made in the cookie notice. They cannot be switched off, because the Website will not work without them.

Analytics cookies are set by Yandex Metrica (Yandex LLC, Russia) and Google Analytics (Google LLC, USA) only after you press “Accept” in the notice at the bottom of the screen. Until you do, the analytics code is not loaded and no data is sent to it. Yandex Metrica may use Session Replay, which records anonymized visitor actions on the page.

You can withdraw your consent to analytics cookies at any time by clearing the Website’s data in your browser settings – the notice will reappear and you can choose “Essential only”. A detailed list of the items used is given in the separate Cookie Notice.

12. Storage and data localization

The collection, recording, systematization, accumulation, storage, updating and retrieval of the personal data of Russian citizens is carried out using databases located in the Russian Federation, as required by part 5 of Article 18 of the Law. The Website is hosted by a Russian hosting provider on a server located in the Russian Federation.

13. Sharing with third parties

The Operator does not sell personal data and does not share it with third parties, except where required by Russian law and in the following cases:

  • with web analytics services – to the extent described in section 11, and only with the visitor’s consent;
  • with courier services – to the extent needed to ship and deliver your parcel, if you placed an order for delivery;
  • with the hosting provider – for the technical storage of the Website’s data;
  • with public authorities – on the grounds and in the manner set out by Russian law.

14. Cross-border transfer

Using Google Analytics involves transferring anonymized visit data to the United States of America, a country that does not provide adequate protection for the rights of data subjects. Such a transfer is made solely on the basis of the visitor’s consent, given by pressing “Accept” in the cookie notice (clause 1, part 4, Article 12 of the Law), and after the Operator has notified Roskomnadzor of its intention to carry out cross-border transfers of personal data.

If consent to analytics cookies is not given or is withdrawn, no cross-border transfer takes place. Transfers to Yandex Metrica are not cross-border: that data is processed within the Russian Federation.

15. Retention, withdrawal of consent and destruction

Personal data is processed until the purposes of processing have been achieved, and no longer than the periods set by Russian law. Data relating to the performance of a sales contract and to accounting is kept for the periods required by tax and accounting legislation. Anonymized analytics data is stored in line with the settings of the respective services.

You may withdraw your consent at any time by sending a request in free form to dpovolgya@yandex.ru or to the Operator’s postal address. Once consent is withdrawn, the Operator stops processing and destroys the personal data within thirty days of receiving the withdrawal, unless the data must be kept for the purposes set out in part 2 of Article 9 or part 1 of Article 6 of the Law.

16. How to submit a request

A data subject’s request must state the number of the main identity document of the data subject or their representative, the date it was issued and the issuing authority, information confirming the data subject’s relationship with the Operator or otherwise confirming that their personal data is being processed, and the signature of the data subject or their representative.

The Operator replies within ten working days of receiving the request; this period may be extended by no more than five working days, with a reasoned notice sent to the data subject. If data is found to be inaccurate, the Operator blocks it from the moment of the request for the duration of the check and corrects it within seven working days of receiving supporting evidence.

If you believe the Operator is infringing your rights, you may contact the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor) or bring a claim in court.

17. Security measures

The Operator applies the legal, organizational and technical measures required by Articles 18.1 and 19 of the Law, including:

  • appointing a person responsible for organizing the processing of personal data;
  • issuing this Policy and keeping it openly available;
  • assessing the harm that could be caused to data subjects by a breach;
  • limiting the people who can access personal data and the Website’s admin area;
  • using an HTTPS connection for data sent between a visitor’s browser and the Website;
  • keeping software up to date and applying security updates promptly;
  • backing up the Website’s data and controlling the storage media;
  • internal checks that processing complies with the law.

18. Final provisions

The Operator may update this Policy. A new version takes effect as soon as it is published on this page, unless the new version states otherwise. The current version is always available via the link in the footer of every page.
